These are the terms for using Pulmonaut, the iPhone app made by Sebastian Corte ("we", "us"). By installing or using the app you agree to them. If you do not agree, please do not use the app. The Privacy Policy explains how we handle your data and is part of these terms.
Read this first: breathwork can be dangerous
Pulmonaut includes breathing practices, breath-holding (apnea) training, and intense techniques such as Tummo and holotropic-style breathing. These change the levels of oxygen and carbon dioxide in your body. They can cause light-headedness, tingling, muscle cramps, and, in some cases, fainting. Fainting during a breath-hold can be fatal if it happens somewhere unsafe.
- Never practise breath-holds or intense breathing in or near water, including a bath, pool or the sea. Not even shallow water. Shallow-water blackout kills experienced swimmers every year.
- Never practise while driving, operating machinery, standing, or anywhere a fall could hurt you. Sit or lie down somewhere safe.
- Do not use the intense techniques if you are pregnant, or if you have, or suspect you have, epilepsy, a heart condition, high or low blood pressure, glaucoma, a history of fainting, a respiratory condition, a psychiatric condition, or have recently had surgery. Talk to your doctor first.
- Stop immediately if you feel unwell, dizzy, or in pain.
- Do not hold your breath beyond your comfort. Breath-hold training in the app is meant to be gradual. Pushing past the first strong urge to breathe is how accidents happen.
You use the app entirely at your own risk and take full responsibility for judging whether any practice is safe for you.
Not medical advice
Pulmonaut is a wellness and training tool. Nothing in the app, on this website, or in our emails is medical advice, diagnosis or treatment, and the app is not a medical device. Measurements such as breath-hold times and control pause are for your own information and are not a diagnosis of anything. Always consult a qualified healthcare professional before starting any breathing practice, and about any health concern.
Who can use the app
You must be at least 16 years old to use Pulmonaut. If you are under 18, you should use it only with a parent or guardian's permission.
Your account
An account is optional. If you create one, keep your sign-in method secure and tell us if you think someone else has used it. You are responsible for what happens under your account. You can delete your account at any time in the app under Settings → Danger Zone → Delete Account. We may suspend or delete accounts that break these terms or that we reasonably believe are being misused.
Your data and your practice
Your practice records live on your phone. We do not back them up, and we cannot restore them if you delete the app or lose your device. Keep your own iPhone backups if that matters to you. See the Privacy Policy for the details of what we hold and what we do not.
Membership and payments
Part of the app is free to use, and three breathing practices stay free for good. The rest is Pulmonaut Membership, an auto-renewing subscription with a monthly and a yearly plan. Every new install gets three days of full access before a membership is needed.
Membership is sold through Apple's App Store and billed to your Apple Account, under Apple's terms as well as these. The price is shown in the app before you buy. New subscribers get three days free; unless you cancel at least 24 hours before the free days end, the plan you chose is charged. After that it renews automatically until you cancel, which you can do at any time in Settings → Apple Account → Subscriptions or from the app's Manage Subscription page. Cancelling stops the next charge, and you keep access until the end of the period you have paid for. Switching to a longer plan takes effect at once; switching to a shorter one takes effect when the current period ends. Refunds are handled by Apple under its policies, not by us.
What you may not do
- Copy, sell, rent, or redistribute the app or any of its content, including audio, artwork, text and practice designs.
- Reverse engineer the app or try to extract its source code, except where the law expressly allows it.
- Use the app to break the law, or in a way that harms us, other users, or third parties.
- Interfere with the servers or services behind the app, or try to access other people's accounts.
Our content
The app, its name, its design, and all of its content are owned by us or our licensors and are protected by copyright and trademark law. We give you a personal, non-transferable licence to use the app on Apple devices you own or control, under Apple's App Store terms. Nothing here transfers ownership of anything to you.
Availability and changes
We are a small team and the app is a work in progress. We may change, add or remove features, content and services, and we may stop offering the app altogether. We will try to give notice of significant changes, but cannot promise the app will always be available or free of errors.
No warranty
The app is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that it will be accurate, reliable, uninterrupted, safe, or suitable for your particular purpose, and we disclaim all warranties, express or implied.
Limitation of liability
To the fullest extent the law allows, we are not liable for any injury, loss or damage arising from your use of the app or from any breathing practice you undertake, whether or not you followed the app's instructions, and whether the claim is based on contract, negligence or anything else. Where liability cannot be excluded, it is limited to the amount you paid us for the app in the twelve months before the claim, or $50 USD, whichever is greater. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
Apple
These terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Ending these terms
You can stop using the app at any time and delete it. We may end your right to use the app if you break these terms. The sections about safety, our content, no warranty, limitation of liability and governing law survive termination.
Governing law
These terms are governed by the laws of Mexico City, Mexico, and any dispute will be dealt with by the courts there, unless the law of the country where you live gives you the right to bring it elsewhere.
Changes to these terms
We may update these terms. The date at the top tells you when. If a change is significant, we will tell you in the app before it takes effect. Continuing to use the app after that means you accept the new terms.
